LAVON GUTHRIE STATEMENT

Sworn statement of Lavon Guthrie,D.O.B. 2-18-57, S.S.# ***-**-**** Holman Correctional Facility, Atmore Alabama.Date; 04- 18- 2010. The Facts as are stated here-in are true and factual to the best of my recollection. I am voluntarialy giving this statement, there is no gain or benefit to me, other than doing the right thing. I have asked to drop my appeals for the last 15 years. I have been trying to tell the truth and my attorney's kept it blocked. I have asked Harvey Lee Windsor's attorney to visit and take statements, my attorney would not allow this. I am of sound mind of which the courts will so declare in order to carry out my execution. My health is bad due to liver disease, my hand are swollen, I can't write good, having told this information to Harvey Lee Windsor, he transcribes to writing. If the courts demand all evidence within custody and control of the state of Alabama, and it's various agencies to include the evidence of the 2 Franklin County Alabama robberies that did not result in deaths of the victims. Two eyewitness which according to my trial lawyer had identified me and the state would not call testimony as they insist Harvey Lee Windsor was not one of the two men that had robbed them. The evidence being withheld is favorable to Mr. Windsor, It proves his innocence, and the facts will be further explained in my statement. My participation in the commission of these crimes were in fact someone other than Harvey Lee Windsor as my accomplice.Mr. Windsor had no active roll or involvement and is only a victim of circumstances outside his ability of knowledge or control. Most of the states case against me is correct, but the identity of the co- defendant and the facts stated here-in. 02-21-88

Throughout the trial, the state introduced evidence about the death of Randal Pepper in Colbert County;
evidence that had no direct bearing on the crime for which Mr. Windsor was being tried.



Michael Maxwell saw two guys one was inside the station who was wearing a base ball cap, jeans and a long jacket that reached below his pants, had a Light beard and Dark brown or black hair , was 5'11"or taller, the one sitting on the passenger side of the car was 5'9" or shorter, had Blondish Brown hair, he was eating a ice cream cone of which he had seen being sold in this store,there was a wrapper in the trash can but prints were never taken and if they were then they were with held,at one point both of these guys were standing near the ice cream box, prints were taken from that and were unidentified
